16px;">2024年6月25日，本局向当事人送达了《恩平市市场监督管理局行政处罚告知书》（恩市监罚告〔2024〕140号），告知当事人拟作出行政处罚的事实、理由、依据及处罚内容。当事人在法定期限内未提出陈述、申辩意见，也未要求听证。</span></p><p><span style="font-size: 16px;">本局认为：当事人销售尺寸限值不符合国家标准的电动自行车的行为，违反了《中华人民共和国产品质量法》第十三条第二款的规定，构成了销售不符合保障人体健康和人身、财产安全的国家标准和要求的工业产品的违法行为。</span></p><p><strong><span style="font-size: 16px;color: rgb(217, 33, 66);">鉴于当事人案发后积极整改，并积极配合调查，如实交代违法事实，主动提供证据材料，违法情节符合《广东省市场监督管理局关于行政处罚自由裁量权的适用规则》第十七条第一项从轻处罚的情形，决定对当事人予以从轻处罚。</span></strong><span style="font-size: 16px;"></span></p><p><span style="font-size: 16px;">对当事人销售不符合保障人体健康和人身、财产安全的国家标准和要求的工业产品的违法行为，根据《中华人民共和国产品质量法》第四十九条的规定，责令当事人停止销售不符合保障人体健康和人身、财产安全的国家标准和要求的电动自行车，决定对当事人处罚如下：</span></p><p><span style="font-size: 16px;">一、<strong><span style="color: rgb(217, 33, 66);">没收不符合保障人体健康和人身、财产安全的国家标准和要求的“九号”电动自行车6台</span></strong>（整车编码分别为：294822419041461、294822419075745、294822419041232、294822419076032、294822419041333、294822418003118）；</span></p><p><span style="font-size: 16px;">二、<strong><span style="color: rgb(217, 33, 66);">处以罚款12390元。</span></strong></span></p><p><span style="font-size: 16px;">当事人应当自收到本行政处罚决定书之日起15日内，按照《广东省非税收一般缴款书》规定的方式，到指定的银行缴纳罚（没）款，或者通过广东公共服务支付平台电子支付系统缴纳（缴纳方式为：微信/支付宝“扫一扫”缴款）。逾期不缴纳罚款的，依据《中华人民共和国行政处罚法》第七十二条的规定，本局将每日按罚款数额的百分之三加处罚款，并依法申请人民法院强制执行。</span></p><p><span
