16px;">2024年4月10日，我局执法人员依法到当事人位于恩平市某经营场所进行食品安全检查，</span><strong><span style="font-size: 16px;color: rgb(217, 33, 66);">在当事人烘焙间冰柜内发现了4盒超过保质期的榴莲冰皮月饼。</span></strong><span style="font-size: 16px;">当事人涉嫌经营超过保质期的食品，我局遂于检查当天对当事人立案调查，</span><strong><span style="font-size: 16px;color: rgb(217, 33, 66);">并对发现的上述超过保质期的食品采取扣押的行政强制措施。</span></strong></p><p><span style="font-size: 16px;">经查明：当事人已取得《营业执照》和《食品经营许可证》从事餐饮服务、食品销售经营活动。当事人在从事经营活动期间，</span><strong><span style="font-size: 16px;color: rgb(217, 33, 66);">于2023年9月11日从广东喜尚美生态食品有限公司下单采购240盒榴莲冰皮月饼（其中120盒生产日期为2023年8月15日，另外120盒生产日期为2023年9月12日）用于发放员工福利及销售，进货价58元/盒，销售价84元/盒。至案发时止，当事人上述采购的榴莲冰皮月饼剩余4盒，已超过保质期，仍放置于当事人经营场所食品处理区烘焙间的冰柜内，且与其他未超过保质期的食品没有明显区分标识。</span></strong><span style="font-size: 16px;">涉案超过保质期的榴莲冰皮月饼货值金额336元，当事人未获得违法所得。</span></p><p><span style="font-size: 16px;">上述事实，主要有以下证据证明：当事人营业执照、经营者身份证复印件、授权委托书、现场笔录、证据提取单、进货单、实施行政强制措施决定书及清单、询问笔录等。</span></p></section></section></section></section><section data-role="paragraph"><section data-tools="135编辑器" 16px;">2024年6月7日，本局向当事人送达了《恩平市市场监督管理局行政处罚告知书》（恩市监罚告〔2024〕122号），告知当事人拟作出行政处罚的事实、理由、依据及处罚内容。当事人在法定期限内向我局提出陈述、申辩意见，未要求听证。当事人陈述、申辩意见主要如下：一是其诚实经营、合法经营，经营期间无违法处罚记录；二是配合调查，涉案过期榴莲冰皮月饼未售卖，仅为员工工作疏忽，无主观过错；三是初次违法，危害后果轻微，积极配合整改，未造成消费者人身财产损失；四是疫情以来市场惨淡、经营困难，拟处罚数额较大，将对其经营造成打击和不良影响。</span></p><p><span style="font-size: 16px;">经对案件进行复核，本局认为：一是当事人涉案超过保质期的榴莲冰皮月饼存放的位置为经营场所食品处理区内，且与其他未超过保质期的食品没有明显区分标识，应视为违法经营行为；二是我局对当事人拟作出的行政处罚已考虑当事人配合调查，超过保质期的食品未售出，违法行为轻微，社会危害性较小等情节；三是当事人称行政处罚将会对其经营行为造成打击和影响，该陈述、申辩意见不属于可以免于处罚的情节。综上，食品安全关系人民群众生命健康安全,当事人超过保质期涉案食品虽未售出，但具有一定的危害性，对当事人拟作出的行政处罚已综合考虑当事人违法情节，且拟作出的行政处罚已属于减轻处罚，与当事人违法行为的事实、性质、情节以及社会危害程度相当，故对当事人的陈述、申辩意见不予采纳。</span></p></section></section></section></section></section><section style="font-size: 16px;">根据上述违法事实和证据，本局认为：当事人上述行为违反了《中华人民共和国食品安全法》第三十四条第（十）项的规定，构成了经营超过保质期食品的违法行为。</span></p><p style="max-inline-size: 100%;cursor: text;"><span style="font-size: 16px;">鉴于当事人案发后积极配合调查，如实交代违法事实并主动提供证据材料，超过保质期的食品未售出，违法行为轻微，社会危害性较小，违法情节符合《广东省市场监督管理局关于行政处罚自由裁量权的适用规则》第十七条第（一）项、第（二）项减轻处罚的情形，决定对当事人减轻处罚。</span></p><p style="max-inline-size: 100%;cursor: text;"><span style="font-size: 16px;">对当事人经营超过保质期食品的违法行为，根据《中华人民共和国食品安全法》第一百二十四条第一款第（五）项、《中华人民共和国行政处罚法》第五条第二款、第二十八条第一款、《广东省市场监督管理局关于行政处罚自由裁量权的适用规则》第十七条第（一）项、第（二）项的规定，责令当事人立即改正违法行为，并决定处罚如下：</span></p><p style="max-inline-size: 100%;cursor: text;"><strong><span style="font-size: 16px;color: rgb(217, 33, 66);">一、没收超过保质期的榴莲冰皮月饼4盒（生产日期为2023年8月15日和2023年9月12日各2盒）；</span></strong></p><p style="max-inline-size: 100%;cursor: text;"><strong><span style="font-size: 16px;color: rgb(217, 33, 66);">二、处以罚款5000元。</span></strong></p><p style="max-inline-size: 100%;cursor: text;"><span style="font-size: 16px;">当事人应当自收到本行政处罚决定书之日起十五日内，按照《广东省非税收入一般缴款书（电子）》规定的方式，到指定的银行缴纳罚（没）款，或者通过广东公共服务支付平台电子支付系统缴纳（缴纳方式为：微信/支付宝“扫一扫”缴款）。逾期不缴纳罚款的，依据《中华人民共和国行政处罚法》第七十二条的规定，本局将每日按罚款数额的百分之三加处罚款，并依法申请人民法院强制执行。</span></p><p style="max-inline-size: 100%;cursor: text;"><span style="font-size: 16px;">如对上述处罚不服，可在收到本处罚决定书之日起六十日内向恩平市人民政府申请复议，也可在六个月内依法向江门市江海区人民法院提起诉讼。申请行政复议或者提起行政诉讼期间，行政处罚不停止执行。</span></p><p
