66);">恩平市市场监督管理局执法人员依职权对恩平市XX镇中心卫生院XX村卫生室进行药品和医疗器械安全检查</span></strong>，在当事人经营场所药房的货架上发现4种超过有效期的药品，分别是：<strong><span style="color: rgb(217, 33, 66);">“维生素B6注射液”3盒、“一片天咳特灵片”3盒、“白云山咳特灵片”1盒、“脑络通胶囊”27粒，当事人涉嫌使用劣药。</span></strong>本局遂于检查当日对当事人予以立案调查，并依法对上述4种超过有效期的药品予以扣押。</span></p><p><span style="font-size: 16px;">经查实：当事人已取得《医疗机构执业许可证》，诊疗科目：全科医疗科（一般常见病、多发病的诊治，不包含静脉滴注）。<strong><span style="color: rgb(217, 33, style="text-indent: 0em;"><span style="color: rgb(0, 122, 170);"><strong><span style="font-size: 16px;">维生素B6注射液</span></strong></span><span style="font-size: 16px;">，生产企业：遂成药业股份有限公司，国药准字：H41021177，数量3盒，每盒10支，生产日期：2022年01月20日，有效期至：<span style="color: rgb(0, 122, 170);"><strong>2023年12月；</strong></span></span></p></section><p style="text-indent: 16px;">，生产企业：肇庆星湖制药有限公司，国药准字：Z44021297，规格：瓶装，每瓶30粒，剩余27粒，生产日期：2022年01月04日，有效期至：</span><strong><span style="font-size: 16px;color: rgb(0, 122, 170);">2024年01月09日</span></strong><span style="font-size: 16px;">上述超过有效期的“一片天咳特灵片”是当事人于2023年4月10日从广东秦正药业有限公司进货；“维生素B6注射液”于2022年12月8日从广东一片天医药集团有限公司进货；“白云山咳特灵片”是2022年9月2日由广东秦正药业有限公司进货；“脑络通胶囊”是2023年3月15日由广东秦正药业有限公司进货。截至案发时止，上述药品超过有效期后未使用，涉案货值金额49.05元。当事人没有获得违法所得。</span></section></section></section></section></section></section></section><section 16px;">2024年4月30日，恩平市市场监督管理局向当事人送达了《恩平市市场监督管理局行政处罚告知书》（恩市监罚告〔2024〕51号），告知当事人拟作出行政处罚的事实、理由、依据及处罚内容。当事人在法定期限内未提出陈述、申辩意见。</span></p><p><span style="font-size: 16px;">本局认为，<strong><span style="color: rgb(217, 33, 66);">当事人使用超过有效期药品的行为违反</span></strong>了《中华人民共和国药品管理法》第九十八条第一款的规定，属于《中华人民共和国药品管理法》第九十八条第三款第（五）项的情形，<strong><span style="color: rgb(217, 33, 66);">构成了使用劣药的违法行为</span></strong>。</span></p><p><span style="font-size: 16px;">鉴于当事人案发后积极配合调查，如实交代违法事实，主动提供证据材料，<strong><span style="color: rgb(217, 33, 66);">违法商品数量不多，并尚未售出</span></strong>，违法行为轻微，社会危害性较小，当事人的违法情节符合《广东省市场监督管理局关于行政处罚自由裁量权的使用规则》第十七条第（一）项、第（二）项减轻处罚的情形，<strong><span style="color: rgb(217, 33, 2px;">当事人应当自收到本行政处罚决定书之日起十五日内，按照《广东省非税收入一般缴款书》规定的方式，到指定的银行缴纳罚（没）款，或者通过广东公共服务支付平台电子支付系统缴纳（缴纳方式为：微信/支付宝“扫一扫”缴款）。逾期不缴纳罚款的，依据《中华人民共和国行政处罚法》第七十二条的规定，本局将每日按罚款数额的百分之三加处罚款，并依法申请人民法院强制执行。</span></section><section
