建设单位、施工单位应当在工程招标文件、承发包合同和施工组织设计中明确施工现场建筑垃圾源头减量的具体要求和措施，以及建筑垃圾综合利用产品的使用要求。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: 建设项目的初步设计，应当按照环境保护设计规范的要求，将建筑垃圾污染环境防治内容纳入环境影响评价文件。设计单位应当优化工程设计、提高设计质量，从源头上减少建筑材料的消耗和建筑垃圾的产生，提高对建筑垃圾综合利用产品的使用。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: initial;border-color: initial;color: rgb(102, 102, 102);font-size: 16px;background-color: rgb(255, 255, 255);font-family: 微软雅黑;"><span style="list-style: 施工单位应当如实编制建筑垃圾处理方案，采取污染防治措施，并在开工前报工程所在地的县级环境卫生主管部门备案；备案后，建筑垃圾处理方案内容有调整的，应当及时报告备案部门。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: sans-serif;">施工单位应当建立建筑垃圾管理台账，记录建筑垃圾的产生量与种类、贮存地点、清运时间、运输单位、清运量、最终去向等情况。并做好以下工作：</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: initial;border-color: initial;color: rgb(102, 102, 102);font-size: 16px;background-color: rgb(255, 255, 255);font-family: 微软雅黑;"><span style="list-style: none;border-width: 0px;border-style: initial;border-color: initial;font-family: arial, helvetica, sans-serif;"> （一）根据建筑垃圾管理相关标准和分类要求，对建筑垃圾进行分类；</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: initial;border-color: initial;color: rgb(102, 102, 102);font-size: 16px;background-color: rgb(255, 255, 255);font-family: 微软雅黑;"><span style="list-style: （四）及时清运施工过程中产生的建筑垃圾至合法处理场所，并按照环境卫生主管部门的规定进行利用或者处置，不得擅自倾倒、抛撒或者堆放工程施工过程中产生的建筑垃圾。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: 居民装饰装修房屋过程中产生的建筑垃圾按照谁产生谁处理的原则，可以采用袋装、桶装等密闭化措施投放到临时堆放点或者收集容器，也可以按照规定排放到建筑垃圾转运设施、综合利用场所、消纳场等指定地点。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: initial;border-color: initial;color: rgb(102, 102, 102);font-size: 16px;background-color: rgb(255, 255, 255);font-family: 微软雅黑;"><span style="list-style: none;border-width: 0px;border-style: initial;border-color: initial;font-family: arial, helvetica, sans-serif;"> 实行物业管理的居住区由物业服务人按照市容和环境卫生责任区管理制度设置建筑垃圾临时堆放点或者收集容器，住房城乡建设主管部门应当指导、监督物业服务人做好装修垃圾处理活动。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: initial;border-color: initial;color: rgb(102, 102, 102);font-size: 16px;background-color: rgb(255, 255, 255);font-family: 微软雅黑;"><span style="list-style: none;border-width: 0px;border-style: initial;border-color: initial;font-family: arial, helvetica, sans-serif;"> 未实行物业管理的居住区由镇人民政府、街道办事处按照便民原则设置建筑垃圾临时堆放点或者收集容器。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: initial;border-color: 市环境卫生主管部门应当会同有关部门建立建筑垃圾信息化管理平台，推进建筑垃圾全过程管控和信息化溯源制度建设，对建筑垃圾处理与服务行为进行信息化管理。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 0px;border-style: 县级以上人民政府应当建立建筑垃圾执法协调机制，由环境卫生主管部门会同公安、生态环境、住房城乡建设、交通运输、水利等相关部门定期开展联合执法，及时发现和查处擅自倾倒、抛撒或者堆放建筑垃圾等违法行为。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style: none;border-width: 违反本办法第十四条第二款、第十六条第一款第一项、第十九条第一款第三项和第二款规定，相关单位未建立管理台账或者生产台账的，由县级以上环境卫生主管部门责令改正；逾期不改正的，处二万元以上二十万元以下的罚款。</span></p><p setedaria="true" tabindex="0" style="text-align: justify;list-style:
