16px;">关于开展违规施工和违规电气焊（割）作业综合整治的通告</span></strong></p><p style="font-size: 14px;text-indent: 2.1429em;">为进一步加强我市施工作业和电气焊（割）作业现场火灾防控，督促单位及相关责任人员认真履行消防安全职责，防范化解重大安全风险，自即日起，在全市范围内开展违规施工和电气焊作业专项整治工作，现通告如下：</p><p style="font-size: 14px;text-indent: 2.1429em;"><strong>一、整治时间</strong></p><p style="font-size: 14px;text-indent: 2.1429em;">即日起至2023年12月31日。</p><p style="font-size: 14px;text-indent: 2.1429em;"><strong>二、整治举措</strong></p><p style="font-size: 14px;text-indent: 2.1429em;">（一）加强平台运用。用工方和作业方可通过粤商通“广东社会消防安全管理平台”中的动火作业管理模块双向扫码，实现核实作业人员持证信息、作业现场管理事项提示和作业过程安全规范提醒等功能，并通过平台实施动火作业审批或备案。</p><p style="font-size: 14px;text-indent: 2.1429em;">（二）集中实施“六查”。各负有安全监管职能部门要按照法定分工负责，采取先服务后执法的方式，集中实施“六查”：一查电气焊（割）作业人员是否持准入类证书上岗，证件是否合法有效；二查动火作业管理制度是否规范完善；三查动火作业审批是否严格；四查现场监督管理是否流于形式；五查安全防范措施是否到位；六查外包、分包、转包是否存在以包代管、包而不管等行为。</p><p style="font-size: 14px;text-indent: 2.1429em;">（三）全面开展电气焊（割）作业人员专项整顿。各企业要全面开展电气焊（割）作业人员专项整顿，对无证人员，应依法予以辞退或转岗；对有证人员，相关企业应开展再教育、再培训，重点强化“四项实操”能力（作业前安全检查能力；熟练使用消防器材能力；按规操作焊接设备能力；作业后消防检查能力），做到“五必修”（电气焊（割）作业法律法规标准；防火防爆注意事项；安全用电规定；危险化学品安全使用管理规定；事故警示教育课程）。</p><p style="font-size: 14px;text-indent: 2.1429em;"><strong>三、违法查处</strong></p><p style="font-size: 14px;text-indent: 2.1429em;"><span style="text-indent: 2.1429em;">作业单位违反上述规定的，负有安全生产监督管理职能的部门将依据相关法律、法规予以行政处罚；情节严重的，依法取消相关操作人员资格证书，涉事企业纳入信用监管，实施联合惩戒。</span></p><p style="font-size: 14px;text-indent: 2.1429em;">（一）中华人民共和国应急管理部令第10号《工贸企业重大事故隐患判定标准》特种作业人员未按照规定经专门的安全作业培训并取得相应资格，上岗作业的应当判定为重大事故隐患。</p><p style="font-size: 14px;text-indent: 2.1429em;">（二）《中华人民共和国安全生产法》特种作业人员未按照规定经专门的安全作业培训并取得相应资格，上岗作业的，责令限期改正，处十万元以下的罚款；逾期未改正的，责令停产停业整顿，并处十万元以上二十万元以下的罚款，对其直接负责的主管人员和其他直接责任人员处二万元以上五万元以下的罚款。</p><p style="font-size: 14px;text-indent: 2.1429em;">（三）《中华人民共和国消防法》违反规定使用明火作业或者在具有火灾、爆炸危险的场所吸烟、使用明火的，可处警告或五百元以下罚款，情节严重的，处五日以下拘留。指示或者强令他人违法消防安全规定，冒险作业的，尚不构成犯罪的处十日以上十五日以下拘留，可以并处五百元以下罚款；情节较轻的，处警告或者五百元以下罚款。构成犯罪的，依法追究刑事责任。</p><p style="font-size: 14px;text-indent: 2.1429em;"><strong>四、举报渠道</strong></p><p style="font-size: 14px;text-indent: 2.1429em;">欢迎广大群众通过“12345”等平台举报违规施工和违规电气焊作业等违法行为，<span style="color: rgb(0, 0, 0);letter-spacing:
